讲座简介

倘若善恶存在多种评判标准，又该如何让全体民众遵从统一律法？倘若人人生来平等，那执掌立法权的权威又该如何确立？在近代欧洲，多元主义与平等主义迫使人们对诸多政治议题进行彻底重构。

霍布斯以一套严苛的政治主权理论，完成了最具代表性的思想重构。这套学说兼具说服力与威慑性，以至于欧洲启蒙时代所有政治思想，本质上都是在不断抵制、驳斥霍布斯的这套理论。

本课程先梳理霍布斯的核心思想，再逐一讲解近代三大与之对立的政治自由理论：洛克秉持的自然法道德普世主义、孟德斯鸠提出的三权分立制衡学说，以及卢梭倡导的人民主权理论。课程最后，将阐释意大利著名法学家、哲学家切萨雷・贝卡里亚的法哲学思想。

If there are multiple conceptions of good and evil, how can we justify everyone's obedience to a single law? If all human beings are equal, on what grounds can we justify the authority that enacts such a law? In modern Europe, pluralism and egalitarianism necessitated a radical reformulation of political problems.

It was Thomas Hobbes who offered the most striking version of this reformulation, in the form of an especially exacting conception of political sovereignty. His conception is both so convincing and so frightening that the entire political philosophy of the European Enlightenment can be described as a series of efforts to reject and refute Hobbes's doctrine.

This course will first expound that doctrine, then examine the three great theories of political freedom that, in the modern era, opposed it: Locke's moral universalism based on natural law, Montesquieu's balance of powers, and Rousseau's popular sovereignty. The course will conclude with a presentation of the legal philosophy of the great Italian jurist and philosopher Cesare Beccaria.

主讲人简介

Philippe Audegean（菲利普·奥德让）

法国索邦大学政治哲学与法哲学教授、博导，法国国家科学研究中心（CNRS）“科学-规范-民主”研究所（SND，UMR 8011）主任。毕业于巴黎高等师范学院、巴黎第一大学。曾任教于尼斯大学、雷恩第二大学、巴黎第三大学等多所法国高校，并曾旅居意大利，在博洛尼亚、威尼斯等地任教。

主要研究近代哲学、意大利启蒙思想、刑法哲学与刑罚理论，切萨雷·贝卡里亚（Cesare Beccaria）思想。其主要著作包括：La Philosophie de Beccaria. Savoir punir, savoir écrire, savoir produire（《贝卡里亚的哲学：论惩罚、写作与生产》，2010年）；Leopardi. Les Petites Œuvres morales（《莱奥帕尔迪：道德小品集》，2012年）；Violenza e giustizia. Beccaria e la questione penale（《暴力与正义：贝卡里亚与刑事问题》，2023年），校订、翻译《论犯罪与刑罚》等经典文本多部，主编集体著作与期刊专号8部；在法、意、英等国权威期刊发表论文50余篇，研究覆盖刑法理性批判、刑罚人道主义、死刑废除、现代刑法起源等领域，成果被多国译介与引用，是该领域国际领军学者。
